Subject with Weapon

On March 19th, 2024, at approximately 2:50 PM police observed a Black 2008 BMW being operated southbound on Elm Street near West Fourth Street. PO observed the driver of the vehicle failed to use a turn signal within a 100 feet of the turn. A traffic stop was made on the listed vehicle on West Fourth Street near Sycamore Street. The vehicle pulled over directly in front of the courthouse, and a female got into the back seat of the vehicle. PO approached the vehicle and confirmed the operator of the vehicle to be Petronilio Velazquez. Velazquez appeared to be extremely nervous and was not making eye contact with me. He was rummaging through the inside of the vehicle as PO asked for driver license, insurance, and registration. Velazquez advised that he did not have his driver’s license on him. About that time he reached towards the driver side floorboard and grabbed a pink item and quickly moved the item into the pouch behind the front passenger seat. The items appeared to possibly be a gun, and PO asked if Velazquez had any firearms inside the vehicle; he advised no. Then PO requested Velazquez to exit the vehicle and he was detained into the rear of the police cruiser, and he was also mirandized. PO then approached the vehicle and spoke to the female in the back seat, Andrea Amistad. She advised that the vehicle belonged to her. PO asked her if there was a firearm inside the vehicle and she advised yes in the diaper bag in the back seat. PO asked if Velazquez took the gun from the front seat and put it into the pouch of the front passenger seat directly in front of her and she advised no. PO then asked for consent to search the vehicle and she consented. In the diaper bag PO located a Pink and Black SCCY CPX-2 9MM firearm, Serial #143206. The firearm was loaded with approximately 9 rounds inside the magazine. PO then went back to speak with Velazquez, who admitted that he had the gun in the front seat with him and did move it to the back pouch of the front passenger seat because he was scared; he knew he was not suppose to possess a firearm. The owner of the firearm is Andrea, who was advised that lying about the incident is a criminal offense. The firearm was taken as evidence, and later placed into the evidence room with the cruiser video as well. A CCH was confirmed on Velazquez, that showed he had a prior Felony Drug Conviction through Florida on 11/17/2004. This case will be sent to the Darke County Prosecutor’s office for review of charges.

Assault

On March 21,2024 at approximately 11:11 PM, police responded to 1190 Russ Road; Quality Inn, in reference to an assault that occurred at 644 Wagner Avenue; Tolly’s Gastropub. PO spoke with the complainant, Shawn Coleman, in the lobby. Shawn stated he wanted charges in reference to a verbal altercation with Tolly’s staff that became physical. Shawn stated multiple times that he wanted to file a report in reference to this incident so he can pursue suing the business. Shawn stated that at approximately 8:00 PM, he arrived at Tolly’s for dinner and to have alcoholic beverages. Shawn stated that at approximately 10:30 PM, he requested his itemized bill so he could pay his tab and leave the business. Shawn stated that after reviewing his itemized bill, he felt that there was a discrepancy in the amount of alcoholic beverages he was being charged for. Shawn stated that he had only consumed two Jack&Cokes but was being charged for three. Shawn advised he then made staff aware of this issue and they became verbally belligerent with him. Shawn stated that he then made the comment “I should bring 70 of my friends,” meaning it as a joke to “lighten the mood”. Shawn stated that this comment escalated the situation and a bartender by the name of Hannah Moore told him to, “get the fuck out of my bar.” Shawn stated Hannah then pushed him towards the door twice and was yelling at him to leave. While PO spoke with Shawn at the Quality Inn, another PO went to speak with, and gather statements from, staff at Tolly’s. Bartenders Hannah Moore and Tonnie Hicks both advised that Shawn became verbally belligerent with them after making them aware of his dispute. Tonnie stated she told Shawn that Hannah had poured his first drink and she had poured two more for him, totaling three drinks. Hannah then told him that they would pay for his third drink to resolve the issue. Both Hannah and Tonnie stated that at this time, Shawn was asked to leave multiple times and refused. They advised he made vague threats against them and continued to refuse to leave. Tonnie stated that she and Hannah then walked outside to escort him out and locked the doors behind him. Both Hannah and Tonnie stated that they never physically touched Shawn during this altercation. This was also stated by a customer in the bar, Ryan Trent, who witnessed the altercation. Shawn, Hannah, Tonnie and Ryan all filled out written statements. Shawn also filled out a victim’s rights form, all of which will be attached to this report. Per Tolly’s staff, Shawn was verbally warned for trespass from Tolly’s. Staff also advised that there are no cameras inside the business. Shawn had no visible injuries associated with this incident. There will be no charges at this time.

Vandalism

On March 22nd, 2024, at approximately 6:04 AM police was dispatched to 1350 Benden Way, in reference to a vandalism complaint. PO made contact with the victim, Heather Trittschuh who advised someone slashed all four of her car tires. PO observed her maroon colored Kia in the parking lot with all four car tires completely deflated from being slashed. Heather advised me she believed Dustin Burton was the individual who slashed her tires. PO asked Heather why she believed that, and she stated she and Dustin were in an argument the night prior because Heather wouldn’t allow Dustin to stay with her in her apartment. Heather advised she knew Dustin was upset over this. PO asked Heather if she knew of any cameras on the property. She stated she was unsure but that she was going to contact the property manager when he came in to ask for any video. PO advised Heather to reach back out if he did have video, and took photos of her vehicle and of the tires. Heather was able to obtain video footage of the parking lot that PO was able to review on March 23rd, 2024. PO watched the video and observed a subject walking into the parking lot at 8:30 PM on March 21st. The subject walks through the parking lot, and can be seen slashing the tires to Heather’s car at approximately 8:31 PM before leaving the parking lot. In the video the subject had his hood up and his face could not be seen. The suspect was wearing blue jeans and a camo colored coat with a gray hoodie underneath. The subject appeared roughly over 6 foot tall and appeared to be a stocky build. It did appear on video to be a male subject. The overall appearance of the subject matched the physical description of Dustin Burton. However it is not possible to ID him strictly off of the video. Heather did not have an address for Dustin, advising he was homeless to her knowledge. She also advised she did not have a phone number for him stating he didn’t have a working phone number. The above mentioned video was attached to this report. PO has been unable to locate Dustin Burton to question him regarding the incident. Once PO is able to make contact with him, he will be questioned regarding it, and criminal charges will be pending more information.

Animal Problem

On March 22, 2023 at approximately 6:23 PM, police was dispatched to 212 Surrey Lane in reference to an animal complaint. Prior to his arrival the PO received video from Janell Parks who lives at 212 Surrey Lane showing a black and white dog, which appears to be a Husky mix running through her front yard and driveway. Janell stated that at 6:04pm on March 23, 2024 Robert Delaney’s dog was on her property and this is not the first time its happened. Janell stated both of Roberts dogs have been on her property several times, and that she does not want them there. PO then spoke to Robert Delaney who lives at 214 Surrey Lane. Robert stated that his dog did get out shortly before PO arrived but he was able to get it back onto his property. Robert stated that his dog is a black and white Husky mix. Robert brought the dog out for the PO to see. Roberts dog matches the dog from the video provided. Robert also claimed responsibility for the dog. Robert was issued a citation for animal at large. A copy of the video provided by Janell will be attached to this report as evidence. Janell also filled out a written statement.

Wanted Person

On March 23rd, 2024, at approximately 1:38 AM, police observed a male subject walking in the parking lot of 201 Wagner Avenue, Speedway. The male subject was walking with his hood up and head down as if to avoid me seeing his face. PO pulled into the parking lot and tried to get to the front door before him so PO could see his face. As PO approached the front door in his cruiser, the male subject had his hand on the door to the business. The male then took off running around the north side of the building, then east onto East Main Street. PO pursued the subject in his cruiser before parking the vehicle on East Main Street, and continuing the chase on foot. PO chased the subject through a residential yard north bound towards the YMCA. PO ordered the subject to stop and after about a couple minutes of running the subject stopped and he was ordered to the ground. The subject was detained and mirandized. The subject identified himself as Matthew Rutherford, who PO knew to have an active warrant. Through LEADS/NCIC it was confirmed that Matthew had an active warrant through the Greenville Police Department for failing to appear on original charge of driving under suspension, bond $525. Matthew was arrested and the handcuffs were double locked and gap checked. Matthew was transported to the Darke County Jail and released to staff.

Wanted Person

On March 23, 2024 at approximately 6:35 PM police arrived at 1343 N. Chippewa to serve a felony warrant for Bradley Crum. PO spoke to Lanny Spahr who advised that Bradley Crum was at the residence. PO then made contact with Bradley. Dispatch confirmed Bradley’s warrant which was for a probation violation with an original charge of dangerous drugs through Darke County Sherriff’s Office, with no bond. PO placed Bradley in handcuffs. PO then transported Bradley to the Darke County jail and was released to the staff.

Neighbor Disput

On March 25, 2024 at approximately 2:18 PM police responded to the Greenville Police Department; 122 West Main Street, reference an animal/trash complaint. PO made contact with the complainant, Krystal Burke. Krystal stated that she lives at 768 Gardenwood Drive and is having problems with her neighbor, Monique Philpot, who lives at 774 Gardenwood Drive. Krystal stated that on 3/23, Monique let her three dogs out of the back door, and two of them ran along her fence line that separates the backyards. Krystal stated that her fence does not go all the way to the property line and believes the dogs were on her property. Krystal also stated that loose trash is piling up on Monique’s property. Krystal filled out a written statement and provided a copy of the video. In the video the dogs never entered into Krystal’s fenced in yard and Monique was outside with them the entire video. It is also difficult to tell where the property line is at and the fence is the only distinguishing marker. At this time there is insufficient evidence to file charges for animal at large. PO also drove past 774 Gardenwood Drive and did not observe any loose trash.

Trash/Dumping

On March 26th, 2024 around 10:17 AM police was dispatched to 750 Martin St. on a trash notice. PO was not able to make contact with anyone at the residence, trash notice was posted at front door. PO observed trash all over the backyard and blowing around into the surrounding yards. Owner of the address is Thompson Rentals II LLC. They were advised of the complaint. SSD Delk was emailed about the violation.
